Sage mobil uygulamasını ve sage.kitchen web sitesini kullanırken geçerli olan koşullar. Hesap kurarak veya hizmetimizi kullanarak bu şartları kabul etmiş sayılırsınız.

1. Taraflar ve kabul

Bu Kullanım Şartları ("Şartlar"), Sage Kitchen ("biz", "Sage") tarafından işletilen Sage mobil uygulaması ("Uygulama") ve sage.kitchen web sitesi ("Site") için geçerlidir. Hizmetimizi kullanarak bu Şartları okuduğunuzu, anladığınızı ve kabul ettiğinizi beyan etmiş olursunuz.

Şartları kabul etmiyorsanız Uygulamayı kullanmayın ve hesabınız varsa Ayarlar üzerinden silin.

2. Hizmetin kapsamı

Sage; ev mutfağındaki gıdaların takibi, alışveriş listesi yönetimi, beslenme takibi, AI destekli tarif önerisi, sosyal tarif paylaşımı ve ilgili yardımcı özellikleri sunan bir mobil uygulamadır. Belirli özellikler ücretli abonelik ("Sage Premium") gerektirebilir.

3. Hesap oluşturma ve uygunluk

  • Sage'i kullanmak için en az 13 yaşında olmalısınız. 13-18 yaş arasındaysanız ebeveyn veya yasal vasinizin onayıyla hesap açabilirsiniz.
  • Google ile Giriş, Apple ile Giriş veya anonim oturum yöntemleriyle hesap açabilirsiniz. Hesap bilgilerinizin doğruluğundan ve güncelliğinden siz sorumlusunuz.
  • Hesabınızın güvenliğini korumak (cihaz parolası, oturumun başkalarınca erişilmemesi vb.) sizin yükümlülüğünüzdür.
  • Bir gerçek kişi yalnızca bir hesap açabilir; ticari kullanım için ayrıca bizimle iletişime geçmeniz gerekir.

4. Sage Premium aboneliği (Apple In-App Purchase)

Premium abonelik Apple App Store üzerinden satın alınır ve şu koşullara tabidir:

  • Otomatik yenileme: Abonelik, mevcut dönemin sonundan en geç 24 saat önce iptal edilmediği takdirde otomatik olarak aynı süre için yenilenir.
  • Ücretlendirme: Yenileme ücreti, mevcut dönemin sona ermesinden 24 saat önce Apple Kimliğinize bağlı ödeme yöntemine yansıtılır. Fiyat App Store'da gösterildiği gibidir; bölgesel vergiler ödemeye dahil olabilir.
  • İptal: Aboneliğinizi istediğiniz zaman iPhone Ayarlar → Apple Kimliği → Abonelikler menüsünden veya App Store'dan iptal edebilirsiniz. İptal, mevcut dönem sonunda etkili olur — kalan süre boyunca Premium özelliklere erişiminiz devam eder.
  • Ücret iadesi: Apple uygulama satışlarından ücret iadesi taleplerini doğrudan Apple yürütür. Talepleri reportaproblem.apple.com üzerinden iletebilirsiniz.
  • Ücretsiz deneme: Eğer ücretsiz deneme sunulursa, deneme süresi sonunda iptal edilmediği sürece ücretli aboneliğe geçiş yapılır.

5. Kabul edilebilir kullanım

Sage'i kullanırken aşağıdakileri yapmamayı kabul edersiniz:

  • Uygulamanın güvenlik önlemlerini aşmaya çalışmak veya yetkisiz erişim girişiminde bulunmak.
  • Otomasyon, scraping veya botlarla hizmeti kötüye kullanmak.
  • Başka kullanıcıların hesaplarına izinsiz erişmeye çalışmak.
  • Hukuka aykırı, hakaret içeren, nefret söylemi taşıyan, telif hakkını ihlal eden veya zararlı içerik yayınlamak.
  • Spam, reklam, zincirleme mesaj veya istenmeyen içerik göndermek.
  • Sage altyapısına aşırı yük bindirecek istek hacimleri oluşturmak.
  • Üçüncü kişilerin gizliliğini ihlal eden veya rızası olmadan kişisel bilgilerini paylaşan içerik yayınlamak.

6. Kullanıcı içeriği ve lisans

Uygulamada paylaştığınız tarifler, yorumlar, fotoğraflar ve diğer içerikler ("Kullanıcı İçeriği") sizin mülkiyetinizdedir. Sage'e yalnızca hizmeti sunmak, görüntülemek, dağıtmak ve geliştirmek için dünya çapında, ücretsiz, devredilebilir alt lisans hakkı tanımış olursunuz. Bu lisans hesabınızı sildiğinizde sona erer (kanunen saklamamız gereken arşiv kopyaları hariç).

Paylaştığınız içeriğin telif hakkına sahip olduğunuzu veya gerekli izinleri aldığınızı taahhüt edersiniz. Sage, ihlal şüphesi taşıyan içeriği inceleme, kaldırma veya hesabınızı askıya alma hakkını saklı tutar.

7. AI içeriği ve sorumluluk reddi

Sage, yapay zeka destekli tarif önerileri, beslenme analizi ve gıda eşleştirmeleri sunabilir. Bu içerik genel bilgilendirme amaçlıdır ve aşağıdaki yerine geçmez:

  • Lisanslı bir diyetisyenden alınacak profesyonel beslenme tavsiyesi,
  • Bir hekimden alınacak tıbbi tavsiye, teşhis veya tedavi önerisi,
  • Resmi gıda güvenliği kurumlarının yönlendirmeleri (saklama süresi, alerjen, vb.),
  • Alerji, gıda intoleransı veya kronik hastalıklara ilişkin uzman görüşü.

AI çıktıları yanlış, eksik veya güncel olmayan bilgi içerebilir. Beslenme, alerjen veya sağlık etkileri konusunda kararlarınızı uzmanınızla doğrulayın.

8. Fikri mülkiyet

Sage markası, logosu, Uygulama ve Site tasarımı, kaynak kodu, metinler, görsel sistem ve diğer içerik unsurları Sage'ye veya lisans veren üçüncü taraflara aittir; ulusal ve uluslararası fikri mülkiyet mevzuatı ile korunur. Bu Şartlar, hizmeti şahsi ve ticari olmayan amaçlarla bu metinde belirtilen şekilde kullanmanız için size sınırlı, geri alınabilir, münhasır olmayan ve devredilemez bir lisans verir.

9. Üçüncü taraf hizmetler

Sage; Google Firebase, OpenAI, Apple ve Cloudflare gibi üçüncü taraf altyapı sağlayıcıları kullanır (detaylar için Gizlilik Politikası). Bu sağlayıcıların hizmet kesintisi veya politika değişiklikleri Sage'nin işleyişini etkileyebilir; bu durumlardan Sage doğrudan sorumlu değildir.

10. Hizmet değişiklikleri ve kesintiler

Ürünü geliştirmek, yasal yükümlülükleri karşılamak veya teknik nedenlerle özellikleri ekleyebilir, değiştirebilir veya kaldırabiliriz. Önemli değişikliklerde uygulama içi bildirim veya e-posta ile haber veririz. Geçici bakım, güncelleme veya teknik arıza nedeniyle hizmet kesintisi yaşanabilir.

11. Hesabınızın sonlandırılması

Bu Şartları ihlal eden, başka kullanıcılara zarar veren veya hizmeti kötüye kullanan hesapları uyarısız askıya alabilir veya kalıcı olarak kapatabiliriz. Hesabınızı istediğiniz zaman Uygulama içinde Ayarlar → Hesabımı Sil seçeneğinden silebilirsiniz; veriler 30 gün içinde tamamen silinir.

Hesap sonlandırılması Premium abonelik ücret iadesi hakkı doğurmaz; bu tür talepler Apple üzerinden yürütülür.

12. Sorumluluk sınırı

Yürürlükteki hukuk izin verdiği ölçüde, Sage hizmeti "olduğu gibi" ve "kullanıma sunulduğu şekilde" sağlar. Ticari elverişlilik, belirli bir amaca uygunluk veya hata içermeme yönünde açık veya zımni garanti vermez.

Sage; dolaylı, arızi, özel veya sonuç olarak ortaya çıkan zararlardan (kâr kaybı, veri kaybı, iş kaybı vb.) yasalar izin verdiği azami ölçüde sorumlu değildir. Sage'nin toplam sorumluluğu her halükarda son 12 ayda Sage'ye ödediğiniz tutarla sınırlıdır.

13. Tazminat

Bu Şartları ihlal etmeniz, hukuka aykırı kullanımınız veya üçüncü kişilerin haklarını ihlal etmeniz nedeniyle Sage aleyhine açılacak taleplerde, Sage'yi tazmin etmeyi ve zararsız kılmayı kabul edersiniz.

14. Geçerli hukuk ve uyuşmazlık çözümü

Bu Şartlar Türkiye Cumhuriyeti hukukuna tabidir. Bu Şartlardan kaynaklanan veya bunlarla ilgili uyuşmazlıklarda İstanbul Merkez (Çağlayan) Mahkemeleri ve İcra Daireleri yetkilidir. Avrupa Birliği'nde ikamet eden tüketiciler, bulundukları ülkenin tüketici koruma mevzuatının emredici hükümlerinden faydalanma hakkını saklı tutar.

15. Şartların güncellenmesi

Bu Şartları zaman zaman güncelleyebiliriz. Önemli değişikliklerde uygulama içi bildirim veya e-posta ile bildiririz. Güncellemeler yayımlandıktan sonra hizmeti kullanmaya devam etmeniz, güncel Şartları kabul ettiğiniz anlamına gelir.

16. Bütünlük ve bölünebilirlik

Bu Şartlar, Sage Gizlilik Politikası ile birlikte taraflar arasındaki anlaşmanın tamamını oluşturur. Şartların herhangi bir hükmü geçersiz veya uygulanamaz hale gelirse, kalan hükümler tam olarak yürürlükte kalmaya devam eder.

The terms that apply when you use the Sage mobile app and the sage.kitchen website. By creating an account or using the service, you agree to these terms.

1. Parties and acceptance

These Terms of Use ("Terms") apply to the Sage mobile app ("App") and the sage.kitchen website ("Site"), operated by Sage Kitchen ("we", "Sage"). By using our service you confirm that you have read, understood, and agreed to these Terms.

If you do not accept these Terms, do not use the App and, if you have an account, delete it via Settings.

2. Scope of service

Sage is a mobile app that helps you track home food inventory, manage shopping lists, log nutrition, get AI-assisted recipe suggestions, share recipes socially, and use related supporting features. Some features may require a paid subscription ("Sage Premium").

3. Account creation and eligibility

  • You must be at least 13 years old to use Sage. If you are between 13 and 18, you may create an account with the consent of a parent or legal guardian.
  • You can create an account using Google Sign-In, Apple Sign-In, or anonymous mode. You are responsible for the accuracy and currency of your account information.
  • Securing your account (device passcode, preventing third-party access to your session) is your responsibility.
  • One natural person may hold one account; commercial use requires separate arrangement with us.

4. Sage Premium subscription (Apple In-App Purchase)

Premium subscriptions are purchased through the Apple App Store and subject to the following:

  • Auto-renewal: the subscription auto-renews for the same period unless cancelled at least 24 hours before the end of the current period.
  • Charging: the renewal fee is charged to your Apple ID payment method 24 hours before the current period ends. Prices are as displayed in the App Store; regional taxes may apply.
  • Cancellation: cancel any time via iPhone Settings → Apple ID → Subscriptions, or via the App Store. Cancellation takes effect at the end of the current period — Premium features remain available until then.
  • Refunds: refund requests for Apple-managed purchases are handled directly by Apple at reportaproblem.apple.com.
  • Free trial: if a free trial is offered, it converts to a paid subscription at the end of the trial unless cancelled.

5. Acceptable use

You agree not to:

  • Attempt to bypass security measures or gain unauthorized access.
  • Abuse the service through automation, scraping, or bots.
  • Attempt to access other users' accounts without authorization.
  • Post unlawful, defamatory, hateful, copyright-infringing, or harmful content.
  • Send spam, advertisements, chain messages, or unsolicited content.
  • Generate request volumes that overload Sage infrastructure.
  • Post content that violates third parties' privacy or shares their personal information without consent.

6. User content and license

Recipes, comments, photos, and other content you post in the App ("User Content") remain your property. You grant Sage a worldwide, royalty-free, sublicensable license to use that content solely to operate, display, distribute, and improve the service. This license ends when you delete your account (except for archival copies we are required by law to retain).

You represent that you own the copyright to content you post or have obtained the necessary permissions. Sage reserves the right to review, remove, or suspend accounts associated with content suspected of infringement.

7. AI content disclaimer

Sage may provide AI-assisted recipe suggestions, nutrition analysis, and food matching. This content is for general informational purposes and is not a substitute for:

  • Professional nutrition advice from a licensed dietitian,
  • Medical advice, diagnosis, or treatment from a physician,
  • Official food safety guidance (storage times, allergens, etc.),
  • Expert opinion on allergies, food intolerances, or chronic conditions.

AI output may be inaccurate, incomplete, or out of date. Verify decisions about nutrition, allergens, or health effects with a qualified professional.

8. Intellectual property

The Sage brand, logo, App and Site design, source code, copy, visual system, and other content elements belong to Sage or its third-party licensors and are protected by national and international IP laws. These Terms grant you a limited, revocable, non-exclusive, non-transferable license to use the service for personal, non-commercial purposes as described herein.

9. Third-party services

Sage uses third-party infrastructure providers including Google Firebase, OpenAI, Apple, and Cloudflare (see Privacy Policy for details). Outages or policy changes by these providers can affect Sage; we are not directly liable for those.

10. Service changes and downtime

We may add, change, or remove features to improve the product, comply with legal obligations, or for technical reasons. We notify users of material changes via in-app notice or email. Service may be temporarily unavailable due to maintenance, updates, or technical issues.

11. Account termination

We may suspend or permanently close accounts that violate these Terms, harm other users, or abuse the service, with or without notice. You may delete your account at any time via Settings → Delete My Account in the App; data is fully deleted within 30 days.

Account termination does not entitle you to a refund of Premium subscription fees; refund requests are handled by Apple.

12. Limitation of liability

To the maximum extent permitted by law, Sage provides the service "as is" and "as available". We make no express or implied warranty of merchantability, fitness for a particular purpose, or freedom from errors.

Sage is not liable for indirect, incidental, special, or consequential damages (lost profits, data loss, business loss) to the maximum extent permitted by law. Sage's total liability in any case is limited to the amount you paid Sage in the 12 months preceding the claim.

13. Indemnity

You agree to indemnify and hold Sage harmless against claims brought against Sage arising from your breach of these Terms, your unlawful use of the service, or your violation of third-party rights.

14. Governing law and dispute resolution

These Terms are governed by the laws of the Republic of Türkiye. Disputes arising from or in connection with these Terms are subject to the jurisdiction of the Istanbul Central (Çağlayan) Courts and Enforcement Offices. Consumers residing in the European Union retain the protection of mandatory provisions of their national consumer protection law.

15. Changes to these Terms

We may update these Terms from time to time. For material changes we notify you via in-app notice or email. Continued use of the service after updates take effect constitutes acceptance of the updated Terms.

16. Entire agreement and severability

These Terms, together with the Sage Privacy Policy, constitute the entire agreement between the parties. If any provision is found invalid or unenforceable, the remaining provisions remain in full force and effect.

17. Contact
